Workers' Compensation Claims: Benefits and Limitations
Lawsuits against an employer, co-employee and the insurance company are not permitted under Arizona law. While the system provides broad benefits to injured workers, benefits are limited to wage replacement and medical benefits. While recovery for wage loss may be capped, medical expenses are covered 100 percent. Unlike personal injury claims, you can not recover pain and suffering or punitive damages. However, you need not prove that your employer was negligent in order to obtain workers' compensation benefits.
Workers' Compensation Insurance
Under workers' compensation law, employers are required to carry workers' compensation insurance. The insurance carrier for the employer is responsible for processing the injured worker's claim. Claims against uninsured employers are processed and paid by the Special Fund of the Industrial Commission.
